Terms and Conditions for the use of this website, buying art and booking workshops at Lochcarron Arts
Please read these terms and conditions carefully, they contain important information about your rights and obligations.
Terms and Conditions Buying Art Packing – Absolute care is taking in wrapping paintings and mounted prints for delivery to collectors. The paintings are wrapped securely in bubble wrap and cardboard packaging. All paintings also have a Certificate of Authenticity. How long? – Paintings will be sent within six working days. Most artwork will be sent via courier such as UPS or Parcel Force. These paintings will have a tracking number so that you can track progress of the delivery and know what day, date and time the artwork is going to arrive. Guarantee – We offer every customer a 14 day no risk money back guarantee on your order. We work hard to ensure that every print sent to you is in perfect condition. If you are not completely happy, prints or paintings can be returned and you refunded. Collectors are, however, responsible for the return of artworks. When the artwork has been returned money will refunded in full. Buying by Installments – If you wish to pay for any of Aileen or Cindie’s artwork via monthly part payments please contact us and we can arrange a schedule of payments – normally the part payment would have to be at least £50-£60 or approximately US$77-$92 (exchange rate at present) per month. Please contact us to discuss options and details Make us an Offer – If you have seen a piece of our artwork that you would dearly love to own but find that the current price stretches your present budget a little too much, then please feel free to make us an offer. Workshops and events 1. Booking a Workshop 1.1 Workshops are open to persons aged eighteen (18) and over. 1.2 To book your place you must pay a deposit and complete a booking/registration form. The full workshop fee must be paid prior to the day of the workshop. 1.3 Places are allocated on a ‘first come first served’ basis. 1.4 If the workshop is fully booked we will add your name to a waiting list and notify you if a place becomes available. 1.6 Lochcarron Arts reserves the right to decline a booking. This decision is final and no fee will be charged. 1.7 The number of participants will be limited to twelve (12) persons, unless otherwise stated. 1.8 Pre-course/event information will usually be sent by email in advance at least seven (7) days prior to the course. 1.9 Tea/coffee, beverages and lunch will be provided as described in the workshop particulars. Participants with special dietary requirements should make us aware of their requirements via the registration form 2. Lochcarron Arts Rights and Obligations 2.0 Copyright. All written workshop content is the intellectual property of the artist/tutor and Lochcarron Arts. No part of such content may be copied or reproduced without written permission of Lochcarron Arts. 2.1 Lochcarron Arts. reserves the right to request any visitor or Course Participant to leave the site without notice if their behaviour compromises the enjoyment, fulfilment, health & safety or activity otherwise not stated of themselves or others.. 3. Payment and Charges 3.1 You must pay the full workshop fee in advance. If you need to cancel at anytime prior to seven days before the start of the course a deposit of 20% will be retained by Lochcarron Arts, but the rest of the course fee will be returned to you. After this date the workshop fee cannot be returned unless the your place has been filled. If the place has been filled then the fee will be returned less 20% deposit. 3.2 The workshop fee is as stated and includes use of the facilities and refreshments as described in the particulars. 4. Workshop Transfer/Cancellation 4.1 You may transfer your booking to an alternative workshop, providing there is a place available on that workshop. However your request must be received at least seven (7) days prior to the date of the workshop. 4.2 Lochcarron Arts reserves the right to cancel the workshop in the event of extenuating circumstances/circumstances beyond their control and will offer to refund the workshop fee in full. You will be notified of this as soon as possible. 4.4 If Lochcarron Arts cancels the workshop you have the option of transferring to another workshop or receiving a full refund of fee already paid. 4.5 If you wish to cancel your booking, you must notify Lochcarron Arts as soon as possible by email. The provisions of clauses 3, 4 and 5 will then apply 5. Refund Policy 5.1 If you cancel your booking within the Cooling Off Period of 7 days of payment you will be entitled to a full refund (including your deposit), pursuant to the Consumer Protection Regulations. 5.2 Subject to clause 4.1, provided you cancel your booking no less than seven (7) days prior to the workshop date, Lochcarron Arts will refund your fee minus the Deposit. 5.3 Lochcarron Arts will refund neither the workshop fee nor your deposit if you: 5.4 cancel your booking within seven (7) days of the workshop date; or 5.5 fail to attend the workshop for any reason whatsoever including (without limitation) ill health. 5.6 Save as provided for in clauses above Lochcarron Arts will be under no obligation to refund your deposit. 5.7 Subject to clause 4.1, You will not be entitled to a refund of any workshop fee or any other fees if Lochcarron Arts terminates this Agreement due to your breach of any of these Terms 8. Accommodation and Travel 8.1 Participants are responsible for their own travel arrangements. 9 Accessibility 9.1 Lochcarron Arts courses include some working en plein air outside. We have made reasonable endeavours to ensure that our venues are disablility accessible 9.1.2 In order to discharge our obligations under the Disability Discrimination Act, customers with disabilities are asked to provide sufficient information about their disability at the time of booking to enable us to alert our venue providers to any special needs. 10 Materials and Equipment 10.1 Our workshops are inclusive of the use of art materials as stated in the particulars. 10.2 Particpants may bring additional art materials. 10.3 Participants may be required to bring some basic equipment with them and should wear appropriate clothing and footwear, as suggested in the particulars. 11 Limitation of liability 11.1 This clause sets out the entire liability of Lochcarron Arts in respect of any breach of these Terms; and any tortuous act or omission including negligence arising under or in connection with these Terms. 11.2 Notwithstanding any other provision in these Terms, neither party’s liability to the other for death or personal injury resulting from its own negligence shall be limited. 11.3 Lochcarron Arts shall not be liable to you for any of the following losses or damage (whether or not losses or damage were foreseen, direct, foreseeable, known or otherwise): loss of revenue; loss of actual or anticipated profits (including without limitation loss of profits on contracts); loss of the use of money; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to or corruption of data; or any indirect, special or consequential loss or damage howsoever. 11.4 Subject to clauses 11.2 and 11.3 above, the total aggregate liability of Lochcarron Arts arising out of, or in connection with these Terms whether for negligence or breach of contract or any case whatsoever shall be capped at the total amount of sums paid to Lochcarron Arts by You. 11.5 The terms of this clause 11 shall survive the termination of these Terms. 12 Changes to Published Information 12.1 Lochcarron Arts make reasonable endeavours to ensure the accuracy of their website but reserves the right to make changes to any workshops (or other information) if deemed necessary. If you have a booking already in place, you will be notified of changes to a workshop in advance wherever this is reasonably possible and you should raise any concerns by email in the first instance. Where the changes are material, the terms of Clause 4 will apply. 13 Notices 13.1 Any notice or other communication required to be given by you to Lochcarron Arts under these Terms, shall be in writing and shall be sent by email 14 Entire Agreement 14.1 These Terms and its Schedule constitute the entire agreement and understanding between the parties and supersedes any previous agreement between the parties relating to the subject matter of this Agreement. 14.2 You acknowledge and agree that in accepting these Terms You do not rely on, and shall have no remedy in respect of, any statement, representation, warranty, or understanding (whether negligently or innocently made) of any person (whether party to these Terms or not) other than as expressly set out in these Terms. Nothing in this clause shall operate to limit or exclude any liability for fraud. 14.3 Unless otherwise expressly provided elsewhere in these Terms, the Agreement may be varied only by a document signed by both parties. 15 Governing Law and Jurisdiction 15.1 These Terms, and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to them or their formation, shall be governed by and construed in accordance with the laws of Scotland and the parties submit to the exclusive jurisdiction of the Scottish Courts. 16 Enquiries and other important information 16.1 Pets are not permitted at Lochcarron Arts’ events unless otherwise agreed with Lochcarron Arts in advance. . Assistance dogs will be permitted but advance notification should be given. 16.2 Photographs will be taken throughout Courses and Lochcarron Arts. reserve the right to use any photographs for their publications or for marketing purposes. |
